By accessing or using Pepperoni’s websites, online ordering platforms, mobile applications, or related services (collectively, the “Sites”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you should not use the Sites.

IMPORTANT: THESE TERMS INCLUDE AN ARBITRATION PROVISION AND A WAIVER OF CLASS ACTION RIGHTS, AS WELL AS YOUR RIGHT TO OPT OUT.

Changes to Terms

Pepperoni’s reserves the right to update or modify these Terms at any time, with or without notice. The most current version will supersede all prior versions. Your continued use of the Sites constitutes acceptance of any changes.

Privacy

Any information you submit through the Sites is governed by our Privacy Policy, which is incorporated into these Terms. Please review it to understand how your information is collected and used.

User Conduct

You agree to use the Sites only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Sites for unlawful, fraudulent, or harmful activities

  • Attempt unauthorized access to systems, accounts, or networks

  • Interfere with the operation or security of the Sites

  • Use automated tools (bots, scrapers, etc.) to access or copy content

  • Transmit viruses or harmful code

  • Post or transmit unlawful, offensive, or misleading content

  • Violate intellectual property or privacy rights

Pepperoni’s reserves the right to restrict or terminate access for violations.

Accounts and Payments

The Sites may allow you to place orders and make payments using accepted payment methods. You agree that:

  • You are authorized to use the payment method provided

  • All payment information is accurate and current

  • You are responsible for all charges incurred

By placing an order, you authorize Pepperoni’s or its payment processors to charge the full amount, including applicable taxes and fees.

Order Accuracy, Returns, and Refunds

All sales are generally final. If there is an issue with your order, you must notify the restaurant promptly at the time of pickup or delivery.

Refunds or corrections may be issued at the discretion of Pepperoni’s or its franchise locations. Approved refunds will be returned to the original payment method.

Text Messaging Program

If you opt into Pepperoni’s text messaging program, you agree to receive recurring automated marketing and service-related messages.

  • Consent is not required for purchase

  • Message and data rates may apply

  • Message frequency may vary

To opt out, reply: STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPT OUT

Pepperoni’s is not responsible for delayed or undelivered messages.

Intellectual Property

All content on the Sites, including trademarks, logos, text, graphics, and design (“Pepperoni’s IP”), is owned or licensed by Pepperoni’s.

You may not use, copy, distribute, or reproduce any content without prior written permission.

Copyright Infringement

Pepperoni’s respects intellectual property rights. If you believe content on the Sites infringes your rights, please contact us with:

  • Identification of the copyrighted work

  • Description of the infringing material

  • Your contact information

  • A statement of good faith belief

  • A statement under penalty of perjury

  • Your signature

Disclaimer of Warranties

THE SITES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

Pepperoni’s does not guarantee that the Sites will be:

  • Error-free or uninterrupted

  • Secure or free from harmful components

  • Accurate or reliable

Limitation of Liability

To the fullest extent permitted by law, Pepperoni’s is not liable for any damages arising from:

  • Use or inability to use the Sites

  • Errors or omissions in content

  • Transactions or communications

This includes direct, indirect, incidental, or consequential damages.

Indemnification

You agree to defend and indemnify Pepperoni’s and its affiliates, employees, and franchisees against any claims or damages arising from your use of the Sites or violation of these Terms.

Dispute Resolution and Arbitration

Any disputes arising from these Terms or your use of the Sites will be resolved through binding arbitration, except where prohibited by law.

  • Claims must be brought individually (no class actions)

  • You waive the right to a jury trial

  • Arbitration will follow applicable arbitration rules

You may opt out of arbitration within 30 days of accepting these Terms by providing written notice.

Eligibility

You must be at least 16 years old to use the Sites. If under 18, you must have parental or guardian consent.

Governing Law

These Terms are governed by the laws of the State of Texas (or insert preferred governing state), without regard to conflict of law principles.

General Terms

  • These Terms constitute the entire agreement between you and Pepperoni’s

  • If any provision is invalid, the remainder remains enforceable

  • Failure to enforce any provision does not waive rights
